Terms of Service

The most important thing to know: Polarys is a tool that supports your decision-making. It is not a guarantee of safety and does not prevent impaired driving. You are always responsible for your own transportation decisions.

1. Acceptance of terms

By downloading, installing, or using Polarys, you agree to these Terms of Service. If you do not agree, please do not use the app.

2. Eligibility

Polarys is intended for users age 17 and older, in line with its alcohol-related content and the App Store's age rating requirements. By using Polarys, you confirm that you meet this age requirement.

3. What Polarys actually does (and doesn't do)

Polarys uses your device's location and, where available, Bluetooth connectivity to detect when you may have spent time at a bar or nightclub, and to prompt you with transportation options when you leave. Polarys is designed as a decision-support tool.

Polarys does not:

  • Measure or estimate your blood alcohol content (BAC).
  • Determine whether you are legally or medically fit to drive.
  • Guarantee that it will detect every venue, every departure, or every relevant Bluetooth connection.
  • Prevent you, or anyone else, from choosing to drive.

Location detection, geofencing, and Bluetooth detection all rely on device hardware, operating system behavior, and network conditions that are outside our control and may occasionally be inaccurate, delayed, or unavailable.

4. Your responsibility

You are solely responsible for your own decisions about transportation, alcohol, and driving. Polarys is meant to make safer options easier to see and act on. It's not a substitute for your own judgment, and it doesn't replace a designated driver, professional help, or plain common sense.

5. No warranty

Polarys is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, reliability, or fitness for a particular purpose. We do not warrant that the app will be uninterrupted, error-free, or that location or Bluetooth detection will function correctly in all circumstances.

6. Limitation of liability

To the fullest extent permitted by law, Polarys and its creators are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the app, or your inability to use it. This includes, without limitation, any incident, accident, injury, or legal consequence related to impaired driving, regardless of whether Polarys detected a venue, sent a notification, or displayed a risk status at the relevant time.

7. Third-party services

Polarys may link out to third-party services such as Uber, Lyft, public transit information, or your device's messaging app. We are not responsible for the availability, accuracy, or performance of these third-party services, and your use of them is governed by their own terms.

8. Changes to the app or these terms

We may update Polarys or these Terms from time to time. Continued use of the app after changes take effect constitutes acceptance of the updated Terms.

9. Termination

We may suspend or discontinue Polarys, in whole or in part, at any time. You may stop using Polarys and delete it from your device at any time.

This document is written to clearly communicate Polarys's limitations and liability position, but it has not yet been reviewed by an attorney. Before public launch, this should be reviewed by legal counsel, particularly the liability and limitation of liability sections, which may need to be adapted based on your business structure (like forming an LLC) and Iowa state law.
